Appeal and cross-appeal from the finding of a valuator appointed to fix compensation for purposes of an expropriation conducted pursuant to the British Columbia Hydro and Power Authority Act, S.B.C. 1964, c. 7. Full taking of a 9.34 ac. parcel of land located near Edgewood. The land was required for water storage purposes. The subject property was developed with a sawmill. The valuator had fixed compensation at $55,000. On appeal the Claimant was awarded $107,940 plus interest and costs. A claim for a further allowance of 10% of the market value for compulsory taking was dismissed. The Claimant's appeal was allowed and the Authority's cross-appeal was dismissed. |
