Application by the Claimants for an order prohibiting three members of the Expropriation Compensation Board from having any further involvement with a compensation claim filed by the Claimant under the Expropriation Act, R.S.B.C. 1996, c. 125 on grounds of bias. The application also sought an order for directions as to the composition of the panel which will hear the compensation claim and an order for special costs. The court dismissed the application and granted costs to the Authority and the other parties.
The court also considered applications to have the action dismissed as against the District of Delta and for an order requiring two witnesses to attend for cross-examination on their affidavits. The application to dismiss the action against Delta was granted and the application to cross-examine on affidavits was dismissed. |
