Application by the expropriating authority for determination of compensation payable pursuant to the Expropriation Act, R.S.C. 1970, c. E-19. Partial taking of 42 ac. of land from a parent parcel approximately 151 ac. in size located in Surrey, B.C. The land was expropriated for the purpose of establishing an intermodal facility adjacent to the Defendant's railway. The court awarded $1,251,300 for market value of the land taken and $317,610 for reduction in value to the remaining land plus interest at the prescribed rates. Solicitor-client costs were awarded to the Defendant owner. |
