Application by an owner to the Alberta Land Compensation Board for determination of compensation pursuant to the Expropriation Act, S.A. 1974, c. 27. Full taking of the Claimant's fee simple interest in three adjacent parcels of land located in the City of Lethbridge. The land was taken for purposes of a Provincial Court House. At the date of taking the subject property was developed with a concrete block building from which the Claimant operated a muffler installation business. The subject property was located in the downtown core of the city and adjacent to a muffler distribution warehouse operated by a related company. It was alleged that the location of the subject property gave the owner a special economic advantage. However, this aspect of the claim was dismissed. The Board awarded compensation for market value of the land taken in the amount of $250,000 plus $76,567.55 for disturbance damages and costs. |
